URGENT: WRITE THE FDA
The FDA is trying to smother the handmade cigar industry. We need your help.

If you’re a friend of the cigar, now is the time to write Washington. The Food and Drug Administration is making it harder and harder for family-owned, handmade cigar companies to produce and sell their products. The new rules are unnecessary and highly political, and they will drive companies out of business, leaving you with fewer choices in your humidor, changing the cigar industry forever.

It needs to stop.

Write the new FDA commissioner, Dr. Scott Gottlieb, and President Donald Trump. Let them know how you feel. Tell them handmade cigars deserve an exemption from FDA control. It’s time to deregulate the handmade cigar industry and let this small, artisanal and venerable business continue without government interference.

It also ignores pipe tobacco, which is subject to the same idiocy. FWIW my sample letter is below:  I am protesting the FDA’s over-regulation of the handmade cigar and artisanal pipe tobacco industry. Please, keep this family owned and artisanal industry intact, and leave handmade cigar and hand blended pipe tobacco makers alone. I understand how the need to keep children from smoking was behind this ill-conceived measure. Nobody thinks that having youngsters smoke is a good idea. Like you, I am appalled at the parasites who deliberately market candy-flavored tobacco products to teenagers, even though I doubt that the flavorings themselves present any separate danger.  However, teenagers are not walking around with $15 cigars or briar pipes filled with hand-blended pipe tobacco! We adults who enjoy these habits in a sane manner know the risks which we are taking, and have made a conscious decision to incur them, as we do when driving a car or undertaking other potentally dangerous activities. The artisans who supply us are following a vocation, the way people who make musical instruments or custom fly rods do. I am hoping your background and expertise will enable you to better guide the FDA, particularly in regard to regulations and the need for rigorous scientific proof and substantive impact determination prior to issuing new and as a requirement for justification of existing regulations. As an occasional handmade cigar smoker, I am writing you to urge you to de-regulate the handmade cigar industry. It is composed primarily of small and medium-sized businesses, many of them family owned, making a product which is enjoyed by adults, free United States Citizens who have the right to make informed decisions as to their health and safety. Recently, the FDA imposed upon the handmade cigar industry severe operational restrictions and regulations, the result of which is severely limiting the introduction of new products. Even more restrictions are scheduled to follow in the coming months. Even If these regulations were based upon a solid scientific proof of impact and comprehensive analysis of costs and benefits to society, such far reaching regulation of a product enjoyed by adults who are well informed of the risks is questionable. Even more damning though, as a person who has been interested and highly involved in science since I was 8 years old, I am shocked at the sloppy science done by the FDA under the Obama administration that was used in part to justify these new regulations as well as the total lack of effective and objective review of the benefits, risks, and costs of these same regulations. In this case, the incorporation of both small machine made cigars with large hand rolled cigars in studies in order to determine risk profiles is completely unacceptable. And the assumptions that any advertising somehow means youth are targeted by an industry is without any substantive proof. As is the belief that the consumers of these products are unaware of the risks and thus every cigar box must include visually imposing inflated warnings based upon limited scientific support. We have had enough of agenda based science that uses inappropriate and unvalidated models to reach pre-determined conclusions. We need less government regulation, not more, and a free society involves more than just the right to vote. A new study, partially funded by the FDA and published on January 26 in The New England Journal of Medicine, documented that premium cigars are not being smoked by the youth of America. The two-year study looked at the behavior of more than 45,000 people, including 13,651 youths, and found that the number of youths who frequently or regularly smoke handmade cigars was less than one percent—statistically irrelevant. Handmade cigars are enjoyed by adults, period. Please exempt the handmade family cigar industry from FDA regulation. As a responsible tax paying adult American citizen, there is nothing more enjoyable than a high quality handmade cigar paired with a nice bourbon to celebrate a family or personal milestone.
