San Jose Bans Smoking in Parks

Posted: Monday, November 05, 2007

By Michael Moretti

San Jose, has become the latest city in California to pass an ordinance that forbids lighting up in public parks.

Last week, following in the wake of outdoor puffing prohibitions in San Francisco, Oakland, Los Angeles, San Diego and many others, the San Jose City Council overwhelmingly elected to extend its indoor smoking ban to include its 160 public parks. Proponents claim it's a win for the cause of public health, while opponents think this ordinance extends the local government's reach too far.

According to local reports, the new law will be enforced largely through the honor system. The vice mayor and ordinance author, Dave Cortese, said that the city would rely on self-compliance.

The new law will go into effect toward the end of November.
